Our company presence on social media uses Mobile Funnel software. Surveys are generated in the form of forms, allowing potential interested parties to apply to our company.
The software is operated by Perspective Software GmbH, a company based in Germany, which offers software for the creation and operation of mobile funnels (https://perspective.co/impressum). The data entered when using Mobile Funnel is transmitted via SSL encryption and stored in our database. We are responsible for this data within the meaning of Art. 24 GDPR.

Perspective Software GmbH is merely the operator of the software and, in this context, a processor pursuant to Art. 28 GDPR. The basis for processing by Perspective Software GmbH is an order processing contract between the controller (GMS) and Perspective Software GmbH. If Perspective Software GmbH processes further data independently to provide its services, in particular for the operation of the Mobile Funnel, you are the controller.
This is discussed in more detail below in the respective processing of personal data.

Mobile Funnel web form for sending applications
When you apply to us via our web form, we collect personal data. This includes in particular your contact details (such as first name, surname, name affixes, private address, (mobile) telephone number, e-mail address) [HG1] as well as other data provided by you regarding your career (e.g. CV, qualifications and degrees, professional experience) [HG2] and your person (e.g. cover letter, personal interests). This may also include special categories of personal data (e.g. details of a severe disability). Your personal data is generally collected directly from you as part of the application process and encrypted during electronic transmission. The data originates from the application form to be completed online and from the uploaded files.
The data processing serves to initiate an employment relationship. The primary legal basis for this is Section 26 (1) BDSG. In addition, consent pursuant to Art. 6 para. 1 lit. a, 7 GDPR in conjunction with Section 26 para. 2 BDSG can be used as a data protection authorization provision. If the processing of your data is based on consent, you have the right to withdraw your consent at any time with effect for the future.
Within our company, only those persons and departments (e.g. Human Resources) have access to your personal data that absolutely need it to carry out the application process or to fulfill our legal obligations. If necessary, your application will be forwarded to the responsible person for review. Under no circumstances will your personal data be passed on to third parties without authorization.
Your data relating to an application for a specific job advertisement will be stored and processed by us during the ongoing application process. After completion of the application process (e.g. in the form of an acceptance or rejection), the application process including all personal data will be deleted from the system six months after completion of the application process. In the event of an acceptance, we reserve the right to keep your application for longer if the start date is more than six months in the future.

Access logs (“server logs”)
Every time the Funnel is accessed, general log data, so-called server logs, are automatically recorded. These data are generally pseudonyms and therefore do not allow any conclusions to be drawn about a natural person. Without this data, it would not be technically possible in some cases to deliver and display the content of the software. In addition, the processing of this data is necessary for security reasons, in particular to control access, input, forwarding and storage,

The user’s IP address is not stored. However, the user is assigned a so-called session ID. The scope of this logging does not exceed the usual scope of any other website.

Collection of user behavior data

All data entered by the user when using the Funnel (e.g. answering form fields; use of interactive components) is assigned to the user by means of a session ID and made available to GMS Global Media Services GmbH. GMS Global Media Services GmbH is responsible for the deletion, storage and further processing of this personal data in accordance with current legislation.
Use of cookies
So-called cookies are used in the funnels. These are small text files that are stored on the device you use to access these funnels. The cookies used serve to ensure security when visiting a website (“strictly necessary”), to implement certain functionalities such as standard language settings (“functional”) and to improve the user experience or performance on the website (“performance”). Strictly necessary, functional and performance cookies are used within the funnels, in particular to implement certain default settings such as language, to store answers given even with a poor internet connection or to analyze the performance of a funnel and the channel used by a user to access this funnel. The use of cookies is absolutely necessary for the provision of our services and thus for the fulfillment of the contract (Art. 6 para. 1 lit. b GDPR).

Right to object: You can use your browser settings to determine whether you want to allow cookies or object to the use of cookies. Please note that deactivating cookies may result in the functionality of the funnels being restricted or completely disabled. GMS Global Media Services GmbH has the option of deciding individually for each funnel used which decision options for the use of cookies are given to the user[HG3] . It is the responsibility of GMS Global Media Services GmbH to use cookies in accordance with the applicable legal restrictions.
Rights of data subjects
Below you will find information on the data subject rights granted to you by the applicable data protection law vis-à-vis the controller with regard to the processing of your personal data:
The right to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on its details.
The right to demand the immediate correction of incorrect or incomplete personal data stored by us in accordance with Art. 16 GDPR.
The right to request the deletion of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
The right to demand the restriction of the processing of your personal data in accordance with Art. 18 GDPR if you dispute the accuracy of the data, the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR.
You have the right to be informed in accordance with Art. 19 GDPR if you have asserted the right to rectification, erasure or restriction of processing against the controller. The controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
Right to data portability pursuant to Art. 20 GDPR: You have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller, insofar as this is technically feasible
You have the right to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of the federal state of our registered office or, if applicable, that of your usual place of residence or workplace.
Right to withdraw consent granted pursuant to Art. 7 (3) GDPR: You have the right to withdraw your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned immediately, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Right of objection
If your personal data is processed by us on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that this is done for reasons arising from your particular situation. Insofar as the objection is directed against the processing of personal data for the purpose of direct marketing, you have a general right to object without the requirement to specify a particular situation.
Final provisions
We reserve the right to adapt or update this privacy policy if necessary in compliance with the applicable data protection regulations. In this way, we can adapt it to the current legal requirements and take into account changes to our services, e.g. when introducing new services. The current version applies to your visit.
